Terms of Service
These terms set out the agreement between you and DOZUS when you use the app or this website. They’re written in plain English. If anything is unclear, email dombthomas@icloud.com.
“DOZUS”, “we”, “us”, and “our” refer to Dominic Thomas, sole trader, trading as DOZUS. “You” means the person using the service.
01Acceptance
By creating a DOZUS account, downloading the DOZUS app, or using this website, you are agreeing to these terms and to our Privacy Policy. If you do not agree, please don’t use the service.
02Age requirement
DOZUS is for users aged 16 and over. At sign-up, you must confirm you are at least 16. If you are under 16, please do not create an account.
We do not verify ages beyond this attestation. Apple does some age screening through the App Store; that is separate from us.
03Our service
DOZUS is an audio app for self-development. Each “protocol” is a structured series of audio sessions designed to build a single behaviour over weeks of daily listening.
We can change, suspend, or discontinue any part of the service at any time. If we discontinue the service entirely, we will tell you at least 30 days in advance and give you a route to download anything you’ve purchased where reasonably possible.
04Your account
You are responsible for keeping your account credentials secure. Choose a strong, unique password. Don’t share it with anyone.
You are responsible for activity that happens under your account. If you think someone else has accessed it, contact us at dombthomas@icloud.com as soon as you can and we will help you secure it.
05Acceptable use
When using DOZUS, you agree not to:
- Share your account with another person, or let anyone else use it.
- Copy, distribute, broadcast, sell, or publicly perform any of the audio.
- Reverse-engineer, decompile, or attempt to extract source code or model weights from the app.
- Scrape, crawl, or mass-download content using bots or automated tools.
- Use DOZUS for any commercial purpose — e.g. running group sessions, charging clients to listen, or training another model on our content — without a separate written licence from us.
- Attempt to disable, defeat, or work around any access controls, signed URLs, or DRM.
- Use the service to harass, harm, defraud, or violate the rights of anyone, including us.
06Content licence
When you create a DOZUS account (and, when in-app purchases are added, when you purchase a protocol) we grant you a limited, revocable, non-transferable, non-exclusive licence to listen to that content via the DOZUS app, on devices that you own or control, for your personal non-commercial use.
This is a licence to listen, not a transfer of ownership. We (and our licensors, where applicable) retain all rights, title, and interest in the audio, the protocol structure, the app, and the underlying intellectual property.
07Payments and refunds
At time of writing, DOZUS does not charge for use. When in-app purchases become available, this section will apply:
- Purchases are processed by Apple through the App Store. We do not collect or store your payment card details.
- For UK consumers, the standard 14-day cooling-off period under the Consumer Contracts Regulations 2013 may apply — subject to the exception for digital content that has been downloaded or streamed with your consent. We treat “starting playback” as your consent to begin supply.
- Refunds for App Store purchases are handled by Apple. To request one, visit reportaproblem.apple.com.
- For users outside the UK, your statutory consumer rights under your local law still apply and are not affected by anything in this clause.
Nothing here affects your rights under the Consumer Rights Act 2015 if our service is not as described, not fit for purpose, or not performed with reasonable care and skill.
08Medical disclaimer
DOZUS is wellness content. It is not medical advice, mental health diagnosis, or therapy. It does not replace care from a doctor, psychiatrist, psychologist, or counsellor.
If you have a diagnosed mental-health or medical condition, please speak with your existing clinician before adding any new practice — including DOZUS.
If you are in crisis right now, the resources in our medical disclaimer and crisis lines page are faster and more appropriate than this app. Please reach out to a person.
09Limitation of liability
Nothing in these terms limits liability we cannot exclude by law. In particular, we do not exclude or limit liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be excluded under the laws of England & Wales.
Subject to the above, to the maximum extent allowed by law:
- We provide the service “as is” and “as available” without warranties of any kind, whether express or implied (including merchantability, fitness for a particular purpose, or non-infringement).
- We are not liable for indirect, consequential, special, incidental, exemplary, or punitive damages.
- Our total aggregate liability arising from or related to your use of DOZUS is capped at the greater of (a) one hundred British pounds (£100), or (b) the total amount you paid us in the 12 months preceding the event giving rise to the claim.
You acknowledge that the limitations in this section are an essential basis of our agreement and that without them the terms on which we provide the service would be different.
10Indemnification
To the extent allowed by law, you agree to defend, indemnify, and hold harmless DOZUS, its operator, and its sub-processors from any claim, demand, or expense (including reasonable legal fees) arising from:
- Your breach of these terms.
- Your misuse of the service.
- Your violation of any law or third-party right.
This does not apply to claims arising from our own breach, negligence, or wilful misconduct.
11Termination
You can stop using DOZUS at any time. The fastest way to fully close your account is to delete it — see account deletion for step-by-step instructions.
We may suspend or terminate your account if you materially breach these terms (for example, by reverse-engineering the app, sharing the account, or scraping the audio). Where reasonably possible, we will warn you first and give you a chance to remedy the breach. For serious or repeated breaches we may act without prior warning.
If your account is terminated by us for breach, any access to purchased content may be revoked. If your account is closed by you, the rights and obligations that by their nature should survive (e.g. content licence ending, limitation of liability, indemnification, governing law) will survive.
12Changes to these terms
We may update these terms from time to time. When we do, we will change the “Last updated” date at the top and bump the version number. For material changes, we will notify you inside the app before the new version takes effect. If you keep using DOZUS after the change, you accept the new terms. If you don’t accept them, please delete your account.
13Governing law and disputes
These terms, and any dispute arising out of or in connection with them or the service, are governed by the laws of England & Wales.
If a dispute arises, we ask that you first contact us at dombthomas@icloud.com so we can try to resolve it directly. If that fails:
- For consumer-scale disputes, you may bring a claim in the small claims track of the County Court (England & Wales) or the equivalent court where you reside if local consumer law permits.
- For larger or commercial disputes, the parties agree to attempt resolution through arbitration in London under the London Court of International Arbitration (LCIA) rules, before resorting to litigation.
Nothing in this clause affects your statutory rights as a consumer in your country of residence.
14Severability and entire agreement
If any part of these terms is found to be invalid or unenforceable by a court, the rest of the terms remain in effect. The invalid part will be modified to the minimum extent needed to be enforceable, while preserving the original intent.
These terms, together with our Privacy Policy, form the entire agreement between you and DOZUS regarding your use of the service. They replace any prior agreements or representations.
Our failure to enforce a right or provision is not a waiver of that right or provision.
